Regarding wrong details in registry

29-Jun-2025 (In Civil Law)
My father filed a civil suit for ownership, division and permanent injunction for ancestral property. But my grandfather made a registered gift deed and registered ownership of the land to my uncles. In the registry they have mentioned that there is no civil case pending regarding thi land in any court. Is this point is a matter of farud or not? If this is the matter of fraud please guide me that what can i do in this ?

since your father has already filed a civil suit , immediately file an application to request honourable court to for interim injunction to stop property transfer then amend civil suit to challenge gift deed if property is not self earned by your grandfather also can take objection to stop name transfer by informing about the case to tehsildar or municipality. rest after complete information.

Yes, the fact that your grandfather executed a registered gift deed in favour of your uncles while a civil suit was already pending regarding the same property and the deed falsely stated that no such suit is pending can amount to suppression of material facts and potentially fraud or misrepresentation before the court of law.

Yes, mentioning in the registry that there is no civil case pending regarding the land, despite an ongoing suit, can amount to misrepresentation and possible fraud under Sections 420, 467, 468, 471 IPC. You can: 1. File an application in the ongoing civil suit bringing this fact to the court’s notice and seek an interim injunction against further transfer. 2. File a criminal complaint with the police or Magistrate for cheating and forgery. 3. Approach the sub-registrar’s office to record the dispute and challenge the registered gift deed on grounds of fraud and suppression of material facts. Quick action is important to protect your rights in the ancestral property.
