Regarding recruitment in govt organization

I was selected in a govt org. having 2 seats as per adv. I was selected as 2nd candidate & 1 was in wait list. They provided joining to 1st candidate, who was retired in 7 mnts after joining & they kept me for some upcoming project. After retiring of 1st they provided joining to waitlisted & bypass me, as there was same criteria for both the post & same interview . There were no mention that 1 post for upcoming project and joining will be given after approval in adv. Is it unlawful

Yes it seems unlawful and it will become more clear after reading the advertisement and the policy and the same can be challenged before the Hon'ble High court directly. The clause in the policy regarding appointment/retire will play a major role here.
