Hi, As per Post 2017 & 2024 Guidelines OBC OBC candidates are NOT eligible for Non-Creamy Layer (NCL) if their parents fall under the following “creamy layer” categories: 1. Government Employees – Class I / Group A Automatically fall in creamy layer, regardless of income. Government Employees – Group B (Class II): If both parents are Group B, and at least one of them gets promoted to Group A before the age of 40, then the candidate falls under creamy layer. However, if only one parent is Group B (non-gazetted) and did NOT get promoted to Group A before age 40, then the candidate falls under Non-Creamy Layer (OBC-NCL). Income test is NOT applicable to salaried Group B employees if they do not reach Group A level. In your case: Your father was non-gazetted Group B. Even if promoted or given a pay upgrade at age 41, he never became Group A. Therefore, you are eligible for OBC-NCL (income test doesn’t disqualify you).
