Regarding Non completion of Home Maintenance By Mistri

I made a simple aggrement with Mistri regarding maintenance of my house. I have paid almost 95% of money which we have decided mutually for completion of work. Now he is not picking up my phone. Whenever he picks he says he will come for work in night. But in night also he is not coming to site. Despite many warning he is not coming to site . Problem is that I didn't make a proper aggrement with him. I have all phone recording also . Please suggest some solution.

it is advised that the court will not be able to assist you in such a case because there is no legal written documents of agreement. Any phone calls are generally not accepted by the court as an evidence so it is much better that you get your work done politely without going into the intricacy of involving the legal methods. Any suggestions of legal way will be for the personal benefit of the person

what you want now. whether you want your work to be made to be completed or you want your money back that you have already paid for your work which has not been completed till yet. you paid the money through which mode

First of all rather than going legally you should serve him/her a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. After that if he/she fails to give you a satisfactory reply then you can anytime file a recovery suit in the court to claim your money back along with compensations.

Agreement can be oral or written. He can be made to do for which he took the money and the same can be enforced from the court of law. Not doing the same may send him to jail. For this purpose also you may need a lawyer for this task.
