passport relies from court against FIR.

Hi, at 8/8/2017 my aunty register FIR agents me and my father as section under 406,420,114. that's why we surrender the passport on court. today all most 7 years complete the case is running on Gujarat High Court. Now we want to go on holiday with family so we need back our passport. so can we realis the the passport from court presently?
