Non issuance of maintenance receipt

30-Jun-2025 (In Civil Law)
Hi Sir/Mam, We got our association registered recently and I'm paying the maintenance for last 6 months. But association is not ready to issue the maintenance receipt. I raised the concern with office bearers but no response. What action shall I take and by formally writing to association whether I can hold my maintenance payment until receipt are issued. Please advise

You can issue a formal legal notice to the association through an advocate demanding issuance of maintenance receipts for payments already made, citing your right to proper accounting under applicable cooperative society or apartment association laws. Mention that non-issuance constitutes deficiency in service and financial irregularity. While you may express intent to withhold future maintenance until receipts are issued, it is advisable not to stop payments unilaterally, as it may be construed as default. Instead, deposit future maintenance amounts in a separate escrow or advocate's account and inform the association that the funds will be released upon compliance. You may also escalate the issue to the Registrar of Societies or relevant housing board authority for regulatory intervention.
