Noisy Pet Parrot Kept Outside and its voice echo in society.

03-Dec-2023 (In Civil Law)
I am living on 10th floor, and apparently the society neighbor from other society has bought a pet parrot. Since he is also living on top floor (pent house) of a society, he owns the separate “chatt” (Terrace), and has left the parrot bird out in a cage for 24/7 hours. Parrot screams and whistles about 30 times in a minute, sometimes continuously for hours. This is disturbing my peace, I am unable to work, I get woken up by whistles. Parrot whistles are ear piercing. How to file complaint.

You have a legal right to peaceful enjoyment of your property as well as fundamental right to peaceful sleep . you can file a civil case for restraining your neighbour from interfering with the peaceful enjoyment of your property. The court may issue injunction orders to immediate effects.

Make a complaint to the President or secretary of the society followed by a legal notice to the neighbor. If the issue subsists, then file a complaint to SDM of your area regarding nuisance being created by your neighbor.
