This advisory note is issued to explain the legal procedure for changing one’s name through Gazette Notification, which is the final and legally recognized step for a valid name change in India. Any person intending to change his or her name must first execute a Name Change Affidavit on appropriate non-judicial stamp paper. The affidavit should clearly mention the old name, the new name, the date of change, and the reason for the change. The affidavit must be duly notarized. Thereafter, a public notice of the proposed name change is required to be published in one or more widely circulated newspapers, as per applicable rules. This ensures public intimation and transparency. After publication, an application for Gazette Notification must be submitted to the concerned Government Press or Department of Publication along with the prescribed application form, notarized affidavit, newspaper copies, identity proof, address proof, photographs, and payment of the prescribed government fee. Upon verification and approval by the concerned authority, the name change is published in the Official Gazette. Only after such publication does the name change become legally valid and officially enforceable. Post Gazette notification, the updated name can be used for correction in Aadhaar, PAN, Passport, bank records, educational certificates, and other official documents.
