My neighbour's he is a builder is building the apartment. On April 10

20-Jul-2025 (In Civil Law)
he had the first-floor slab poured. The day before, I called him and advised him to cover the tarpaulins on our walls, the balcony roadside, and the backside passage area. He assured me that he would do it the next morning, but nothing was covered when the flooring work started. As a result, all the cement from the balcony got onto our clothes that were drying there, and it was a mess. he seems to be taking advantage of the situation.

it is clear that the individual responsible for the construction work failed to take reasonable care to prevent foreseeable damage, despite being specifically advised in advance. This constitutes negligence, particularly as the damage (i.e., cement spilling onto clothes and walls) was entirely avoidable had protective measures (tarpaulin covers) been implemented as assured.
