Memorandum of Appearnce for filing papers or aasking time

06-May-2023 (In Civil Law)
In a civil case an advocate purportedly on behalf of the respondent asked for time to file the reply by filing a Memorandum of Appearance. No Vakalatnama was filed by him, Memo of Appearance was also not properly stamped. Was this legal or can it be challenged as Memo of Appearance does not appear to be a substitute for Vakalsatnama.

Yes it can be challenged if it does not have your signature on that, however if you have signed it then it shows your consent. the best part in your favour is that vakalatnama is valid indefinitely till the end of case however memo of appearance is valid for only one date.
