Issuing of my daughter’s ST certficate as a single parent(mother).

30-Apr-2026 (In Civil Law)
I am a single mother(divorced) and no longer in touch with the father of my daughter. But, I state We both belong to the same community: ST, on the basis of which I want to issue my daughter’s ST certificate. I cannot provide ST certificate of her father. Is there any way that my daughter can be issued a certificate on my basis? What are the documents required and procedure needed to be followed?

Your situation is understandable, and the law has evolved to address exactly such cases where the father’s documents are not available. Traditionally, caste (including ST status) is traced through the father. However, courts and authorities have recognised that this cannot be applied rigidly, especially in cases of single mothers, divorce, abandonment, or where the father is not in contact. If you yourself belong to a Scheduled Tribe, your daughter can be considered for an ST certificate on your basis, provided you are able to establish: that you belong to the notified ST community, and that your daughter has been brought up by you in that social environment and community. Authorities now examine the real social upbringing of the child, not just technical lineage. Since you do not have the father’s ST certificate, your application will be treated as a special or scrutiny case, but it is not barred. You should be prepared with the following documents: your own valid ST certificate, your daughter’s birth certificate showing your name, proof of custody (divorce decree, custody order, or affidavit if no formal order exists), your identity and residence proof, school records of the child showing your name as guardian/mother, any community certificates or local authority letters supporting your ST status and social background. You will also likely need to submit an affidavit explaining: that you are divorced / not in contact with the father, that the father’s documents are not available despite efforts, and that the child has been raised entirely within your ST community. In many states, the application is processed through the Tehsildar/SDM office, and may be referred to a Caste Scrutiny Committee for verification. They may conduct a local enquiry, including verification from your native place or community members. Be aware that authorities may initially resist or ask for the father’s documents as a routine requirement. If that happens, you can insist on consideration based on your status and, if needed, challenge any unreasonable rejection before the appellate authority or High Court. The key point is this: your daughter’s eligibility is not automatically denied merely because the father’s certificate is unavailable. The decision will depend on proving genuine ST status through you and her upbringing. In conclusion, yes—your daughter can obtain an ST certificate on your basis, but it may require additional documentation and scrutiny. The approach should be structured and well-documented from the beginning.

Hi, Yes, as per the clarifications made by the Supreme Court as of Dec20205, your daughter can still obtain an ST certificate based on your ST Certificate (if you have one), otherwise proof of belonging to the ST community you are a part of (it is usually a certificate signed by two government servants, saying that you are personally known to them and belong to the ST community. Additionally, you will require your Daughter’s AADHAR Card, her residential proof (electricity bill, water bill etc.), and a proof of DOB (Birth Certificate, School Certificate or passport). Once you have these, you can apply through your state revenue department’s e-portal. The documents you require may vary depending on your state, so it is advised that you consult a legal practitioner in your state to guide you through the process.

Yes a caste certificate may be obtained on the basis of your lineage especially with the concept of maternal lineage being recognised You have to show that your daughter was actually raised under your tribe and that she has faced discrimination due to the same Basically a link has to be established along with a lived experience

yes it is very much possible but you are required to provide the birth certificate of your daughter and your marriage certificate. also will be required is your divorce order which will contemplate that your child was born prior to divorce. if you are a resident of Delhi then it will take a maximum of 30 days to get the certificate once all the documents are submitted
