In my school TC they have wrongly updated my caste.

Hi, In my school TC they have wrongly updated my caste name. My actual caste is DevAdiga but it is updated as only Adiga (Brahmin) so we were also unaware of this. Later we have given the same details for all further degree and master degree which I pursued. Actually my original caste has some reservation as it comes under Category 2A but I have not utilized any of the reservations and benefits till completion of my education. As I was a merrit student it didn't bother me for my studies. Now I wanted to change my caste details given in school and henceforth I need to use my original caste name wherever necessary. Kindly suggest the way. I have not availed any benefits of my real caste till now and was in trouble most of the time because the wrong caste updated in TC (school Transfer Certificate) held up me to get more Mark's all the time as it went have any reservations or scholarships. Kindly advise me. Regards, Arun

Hello Sir, As per law laid by Supreme Court caste can not be changed. Your caste depends upon caste of your father or the way you are brought up. However, you can change your name your name from Adiga to DevAdiga by filling a suit for declaration before civil court and making all your studied schools and colleges.

Hi as per your query please note that according to the recent judgement the power is given to tahasildar to change the caste name by filing a petition. Hence you need to to file a suit for declaration and mandatory injunction against the State Govt., represented by Dist., commissioner and Deputy Director of Public instructions. If the same is not accepted then you have to file a declaration suit before the jurisdictional court stating that you belong to DevAdiga caste and the Caste mentioned in the School TC and educational documents are incorrect. Before filing the suit 60 days legal notice us/ sec.80 of Civil Procedure code will have to be issued to the above said . After 60 days you can file a suit. Prior to this please send a notice to the education board and even to your school and then file the suit. The process might take minimum six months duration.
