Ground floor owner stopping two wheeler parking in common area buildin

27-Jul-2024 (In Civil Law)
I am the owner of top floor in my building and building is old and without parking so all flat owners park their two wheeler in common area of building, but ground floor owner claims that it's his property and file a case in McD and police but both refused that it's a common area and every one have right to park here and it's on road and you passage is also not affected. Than he placed big plants in that area and now he file a case in civil court. I need a advice on this how we should proceed.

sor first of all is the case aginst you or all of the flat owners who are residing in this property. what do you want in this case and is your problem is just regarding the parking or the plants that they have placed.

the claim made by the ground floor owner does not mean anything if the same has been rejected by MCD and the police. if a case has been filed in civil court then he is required to produce the documents that he is the owner of the property which he claims.
