Dear Sir/ Madam It appears you are a little mistaken about the provision of Order VII Rule 11 CPC. If the plaint had a mentioning of cause of action it is treated to be the gospel truth. The question whether the cause of action is maintainable or not is a matter of trial and the plaint cannot be rejected on that ground. However, if no cause of action is disclosed in the plaint, your application of OVII R11 will sustain. However, the ground of limitation is a solid one, though we need to discuss about it at length. If you wish, you may consult me regarding that. I deal in civil cases. Good luck!

Yes, we have extensive experience in original side civil matters, including filing petitions under Order 7 Rule 11 of the CPC. Based on the grounds of limitation and no cause of action, we can draft a well-supported petition. In such cases, it is essential to carefully analyze the plaint to demonstrate how it fails to disclose a valid cause of action and why the suit is barred by limitation. We will also support the petition with relevant case laws to strengthen your position. For example, the Supreme Court’s rulings in cases like T. Arivandandam v. T.V. Satyapal and Popat and Kotecha Property v. SBI Staff Association have laid clear principles for rejection of plaints under Order 7 Rule 11, which can be cited in your petition. Please share all necessary documents, including the plaint, for a detailed review. Once we analyze the documents, we will draft the petition with appropriate legal grounds and case law references to ensure a strong submission. This approach will help in ensuring the prompt dismissal of the suit.
