Discrimination in Tamilnadu UG medical counseling within UR category
08-May-2025 (In Civil Law)
The Directorate of Medical Education in Tamilnadu has a system of treating the top 1218 candidates as Unreserved category irrespective of their original reservation category. But while processing seat allotment for Government colleges, the reserved category candidates within the top 1218 UR pool are given priority for seat selection of their preferred college over other UR candidates despite the seniority in ranking within the UR pool. This discrimination needs to be rectified
Your concern highlights a violation of the merit principle within the Unreserved (UR) category. As per Supreme Court rulings, notably in R.K. Sabharwal v. State of Punjab and Saurav Yadav v. State of Uttar Pradesh (2020), when a reserved category candidate secures a position in the general merit list, they must be treated as a UR candidate for all practical purposes, including seat allotment, unless they opt to avail reservation benefits.
Legal Remedies:
Representation to DME: File a formal representation to the Directorate of Medical Education, Tamil Nadu, citing violation of Supreme Court rulings and demanding rectification in the allotment process.
Writ Petition in High Court: If no corrective action is taken, you may file a Writ Petition under Article 226 of the Constitution before the Madras High Court challenging the discriminatory implementation of the UR pool.
Grounds for Challenge:
Violation of equality under Article 14.
Non-compliance with apex court precedents.
Arbitrary prioritization within the UR pool based on original reservation category.
Interim Relief: Seek stay or re-allotment orders for affected candidates through interim directions if allotments have already been made.
We can assist with drafting the representation and preparing the Writ Petition with proper legal grounds and citations.
