Discontinuation of md seat in a government medical College in Tamilnad
19-Jun-2025 (In Civil Law)
I joined md general medicine in a government college in tamilnadu in 2024 via all India quota. After two months into the course I was diagnosed with severe depression with active suicidal tendancy. The course is acting as a trigger for me and even thinking about seeing and examining patients is giving me anxiety and chest pain . I'm in a point where either to commit suicide or to drop out. Is there any way that i can avail a waiver in the penalty or even a reduction in the penalty. I
If you wish to discontinue your MD (General Medicine) seat in a Tamil Nadu govt. college under AIQ due to diagnosed mental health issues (e.g., severe depression with suicidal tendency), you may seek legal remedies to waive or reduce the penalty. First, obtain a psychiatrist’s certificate from a govt.-recognised doctor stating that continuing the course risks your mental health. Submit a formal resignation request with documents to the Dean and DME seeking waiver on medical grounds. If denied or ignored, approach the Madras High Court under Art. 226, citing Art. 21 and Mental Healthcare Act, 2017, which ensures protection, care, and freedom from forced decisions. Courts have allowed waivers in similar cases. Preserve all records and consult legal support to draft proper representation or petition.

As per your situation, you may seek relief under medical grounds. Severe depression with suicidal tendencies constitutes a valid health concern. You must immediately obtain a medical certificate and psychological evaluation report from a recognized government psychiatrist or mental health institute. Under current regulations, candidates resigning from PG medical courses are liable for penalty and bond conditions. However, by approaching the Selection Committee, DME Tamil Nadu with proper medical records and a formal representation citing mental health issues, you can request waiver or reduction of penalty. Additionally, you may move the High Court under Article 226 seeking exemption from penalty on humanitarian and medical grounds, supported by medical evidence and prior precedents. We can help draft the representation and Writ Petition for effective relief.
