Cooperative Society Loan Recovery from guarantor

22-Oct-2023 (In Civil Law)
I stood as a guarantor for a loan through a co-operative society (Patpedhi) (Location Navi Mumbai) in the year 2017 now the borrower has not been paying the EMI however I understand the fact that the guarantor is liable to repay. but my question is : 1) when the bank contacted me a few months ago and said the borrower and his wife who is also a co-applicant have not paid a single EMI since they took the loan, why it took them to realize that they have not received a single penny for >2years, why they waited so long? 2) also, I was not aware that the borrower's wife is a co-applicant in the loan, and how did the bank sanction the loan when the borrower's wife is just a house-wife with no income. 3) They have not initiated a single action against the applicant &co-applicant and directly holding the guarantor liable for all their dues. 4) The bank has frozen guarantors bank account/salary accounts and are also visiting my office, sending direct letters to our company HR to debit my salary

Hello, in such matters you can initiate civil proceeding and recover the money frim the borrower. Also another way is to initiate criminal proceeding fir criminal breach of trust, cheating and other such charges against the borrowers. The criminal proceeding will give you the quickest remedy in such cases.
