Common Passage Dispute Beside A Pond

02-Jan-2026 (In Civil Law)
I had bought a plot register and mutation by my name with Passage beside a pond . The new owners of this pond say no common Passage besides the pond for my plot. The seller of my plot sells to me mentioning common Passage beside that pond. How do I solve this problem. Please advise. Thank you

If your Sale Deed / Conveyance Deed clearly mentions: a common passage / right of way, and its location beside the pond, then that right is a legal easement, and new owners of the pond cannot deny it, even if: the pond is now in their name, or they purchased it later. Send them a legal notice first to stop the obstrucion and if they dont pay any heed to that than file a civil suit for declaration and injunction that the right to way exists beside the pond and it is an easementary right enjoyed by you.
