Legal steps :- Check Society By-Laws or RWA Rules If you are part of a society, obtain the by-laws. Most will have a clause forbidding misuse of common areas. RERA registration documents may also include this. Send a Written Complaint to the RWA/Management Committee Clearly mention the obstruction and safety concerns. Request removal of items within a fixed timeline. Issue a Legal Notice If the RWA fails to act, you can send a legal notice to the neighbour (through a lawyer) citing: Violation of RERA Violation of Apartment Ownership Act Public nuisance under BNS Risk under fire safety laws Complain to Local Authorities Municipal Corporation: They can issue notices for blocking passages or improper waste storage. Fire Department: They can penalize unsafe practices like storing gas cylinders in open/shared spaces. Approach Consumer or Civil Court If issues persist, you may file a complaint before: Consumer Forum (for deficiency of service by society) Civil Court (for injunction against the neighbour)
