Can I Face Trouble for Exposing Fake RTE Admission in UP?

21-Sep-2025 (In Civil Law)
About 2 yrs ago, I helped a family fill an RTE form online in UP, believing they were eligible. Later I found they run a cash-based business, live well, used a fake income certificate, and even had their 2nd child in private school. Their fraud wasted a seat meant for a poor child. I want to file a complaint on Jansunwai (UP Govt. portal). Since I only did online help unknowingly, will I face any liability if they blame me or if authorities don’t find enough proof ? Can anybody help me pls ?

In the present matter concerning the exposure of alleged fake admissions under the Right to Education (RTE) Act in Uttar Pradesh, it is my considered opinion that you hold a strong legal footing and are unlikely to face any liability, provided your actions are supported by credible material evidence. Under Section 499 of the Indian Penal Code, truth published in the public interest is a valid defence against defamation. Since the RTE scheme is a welfare measure intended for underprivileged children, highlighting fraudulent admissions directly serves public interest. Furthermore, the Whistle Blowers Protection Act, 2014 and constitutional guarantees under Article 19(1)(a) safeguard bona fide disclosures made to protect public resources and prevent misuse of statutory benefits. Reporting such irregularities in good faith and with due diligence shields you from accusations of malice or falsehood. However, to successfully rely on these defences, you must be able to demonstrate the material existence of evidence. This includes documentary proof such as admission records, certificates, or official responses, which substantiate your claims. Without such evidence, allegations risk being treated as unverified assertions. Therefore, maintaining clear, verifiable records and presenting them responsibly ensures your position remains legally secure.

You will not face liability merely for assisting with the online form if you were unaware of the family’s misrepresentation. Law requires mens rea (guilty intention) to hold a person responsible for forgery or cheating. Since you had no knowledge of the fake certificate and derived no benefit, you cannot be prosecuted for their fraud. If you wish to file a complaint on Jansunwai, clearly state that your role was only limited to technical help and that you came to know about the fraud later. Attach whatever supporting details you have (such as their lifestyle, private school admission, etc.) so that authorities can investigate properly. At most, the enquiry officer may call you for a statement, but chances of action against you are negligible if your good faith is evident. The liability rests with the person who knowingly created and used false documents.
