Board is avoiding release of NOC / Affiliation Certificate of a school

19-Nov-2025 (In Civil Law)
I had requested the concerned Board for a copy of the Affiliation Certificate / NOC issued to a school that has been running in the portion (inherited by me) of our ancestral house. Questions: 1. Can they refuse to share a public document like this? 2. Now the Board is asking for property related documents. Is the board entitled to ask for those, when they should have asked (and verified) the same from the school BEFORE issuing the NOC / Affiliation Certificate?

In most cases, No An Affiliation Certificate or NOC issued to a school is a public record. It is not a private document of the school because: It is issued by a public authority (State Education Department / CBSE / CISCE / Local Body). It authorizes a school to operate in a particular jurisdiction. It is meant to be publicly verifiable. Many boards even publish affiliation details on their websites. The duty to submit ownership/lease/permission documents lies entirely on the school, not on a private individual after the fact. Why? Before granting affiliation, every education board has strict requirements: Valid land ownership/lease deed Land use permission Building safety certificates NOC from the owner (if rented) Municipal permissions It is the school’s duty to prove lawful possession and permission to run the institution.
