Birth certificate Record not Registered

10-Jan-2026 (In Civil Law)
I have a hard copy Birth Certificate (DOB 15-09-1996). During police verification for a government job, the DM Record Room, Purba Bardhaman said the details do not match their register and my job is in danger. The hospital says all records were sent to the DM. The DM office states my name is not in the register or another name appears in the registration details. I suspect only a handwritten certificate was issued and proper registration was not maintained. I seek legal remedy for this.

This is a serious administrative lapse, and you do have effective legal remedies. Apply for verification and correction before Registrar (Birth & Death) / DM Under Section 15 of the Registration of Births and Deaths Act, 1969, you are entitled to seek correction or cancellation of erroneous entries. File a written application before the District Registrar (DM office) with copies of hospital record, discharge certificate, school records, Aadhaar, voter card, etc. Seek written clarification from hospital and DM office Obtain written replies under RTI from both the hospital and DM Record Room regarding the entry sent and the entry available. These documents will become strong evidence. Approach High Court by Writ Petition (if urgent due to job) If authorities fail to correct the record or delay, you can file a Writ Petition under Article 226 seeking direction to correct the birth record and issue proper certificate. High Courts routinely grant relief in such cases, especially where livelihood is affected. Police case usually not required This is primarily an administrative failure unless deliberate forgery is proved. Courts have consistently held that genuine citizens cannot be denied rights due to clerical errors of authorities. With proper documents, your claim is legally sustainable.
