typographical mistake in notice given by firm what can be done

A cheque is dishonoured and the notice is issued but there is a typographical mistake in the notice with regard to name of the firm on whose behalf the notice is issued. What to be done now ?

Hello,

It doesn't matter if there is a typographical error with regard to the name of the drawee in the legal notice sent to the drawer of the cheque as the cheque issued by the drawer is in the name of the drawee only and that particular cheque has bounced and you sent the notice basing on that particular cheque so there is no ambiguity. You can now wait for them to settle and if they don't,file the cheque bounce case within the mandatory period. Feel free to contact me if you need any further clarification or help.

Dear Client,
Particulars are insufficient. When did the cheque dishonour and when did the notice get issued. Is the date of issuance of Legal Demand Notice within one month from the date of dishonour of cheque. If it is within one month from the date of dishonour of cheque then issue a corrignedum notice simply stating that the name of firm was wrongly mentioned as so and so and the same may be read as correct name so and so.

The typographical error can be rectified. While filing the complaint the pleading should specify that with regards to the typographical error. This will bring to the notice of the court that the error was only clerical typographical error that does not effect the intended object of the issuing notice.
