Procedure For Attachment Of Properties In A NI Act Case
08-Jun-2025 (In Cheque Bounce Law)
My NI Act case is now in Trial stage and my lawyer has already filed for 20% compensation petition and the order is pending for order with the trial court. Is there any procedure for attachment of assets of the accused person in the NI Act case at this stage and what can be done for my money recovery if the accused does not have any assets belonging to him. The accused is not at all interested in returning the money.
You can file the attachment of asset after the interim order of 20 percent or after conviction only If the accused don’t pay the amount.
Procedure:
• Apply for issuance of Distress Warrant
• Court will attach movable/immovable property of the accused
• Sale proceeds used to recover compensation.
