Plz explain the detailed procedure to file a case of 138 negotiable instrument act in magistrate court after notice....... How to file a case in magistrate's court????

Within 30 days from the date of notice, a complaint shall be filed before the Magistrate Court of Competent Jurisdiction. Thereafter, the court procedure initiates i.e verification, Affidavit of Evidence etc. Consult a Lawyer along with the documents pertaining to the case i.e dishonoured cheque, cheque return memo, legal notice and proof of service. Thereafter, the lawyer will guide you how to proceed.

draft the complaint according to the jurisdiction where the complainant maintains his bank account..
file in the magistrate court where the jurisdiction of the bank falls in the magistrate court..
after filing of the complaint the magistrate shall issue notice to the accused whereby if the notice is served the trial shall commence..
