Advocate Vishwjeet Singh Panwar answered
Look we have to go for simple partition in this scenario Nd you have to built the structure in no time Nd once the partition is done the mutation will be on ur name after that and they won't be able to challenge it as mutation (intekal) is on ur name means u are the real owner of that land now

Q: Brother in law and his family are troubling my sister & her daughter

my brother in law residing in Germany does not take responsibility of his wife and daughter suffering from cerebral palsy and fully dependent on mother. My sister is living in her maternal home after the demise of my mother the situation has worsened. My brother in law owns hotel in dharamshal and other properties in his and in the name of his brother but not giving a small home to his wife and daughter. he has filed a case of divorce but was not granted .he is paying 15000 pm which makes difficult for my sister and her daughter to bear expenses.the lawyer was asked to send him legal summons through embassy but no results. kindly advise as its almost ten years and even after making compromise my brother in law is not taking any family care.he never comes for court hearing only his brother or lawyer comes.

Advocate Vishwjeet Singh Panwar answered
For the service of that person we should seek direction from Hon'ble high court providing the last address of that very person on which he was contacted by anyone or we should seek direction to issue warrants by attaching the copies of summons which was sent to him earlier Nd copies of the orders where it is visible that he has not attended the court below Nd out there we can also seek the enhancement of the amount which he is paying to ur sister and will produce the other relevant documents which will show the assets and income of that very person .
