Q: Consumer Court case againat RWA

RWA has illigally occupied a part of (Reduced the size) my purchased covered parking from builder. 2 sides of my parking has common space for entry/Exit. one side has a piller that separtes from another parking. Fourth/Last side has also piller, where it was reduced by RWA. I have provided all proof of the Parking lines when I got it from Builder. but they ignored all these proof and are not replying on it. I have photos of the parking when I got it from the builder.

Based on your facts, the RWA's action of encroaching upon or reducing your allotted covered parking—despite you possessing proof from the builder—may amount to criminal trespass and also mischief causing wrongful loss. Since you hold photographic evidence and original markings from the builder, you may:1. Send a legal notice to the RWA demanding restoration of your original parking space and restraining them from unlawful interference.2. If they fail to respond, you can file a police complaint under appropriate IPC sections mentioned above.3. My sister filed a maintenance case under Section 125 CrPC against her husband in July 2024. After three court hearings, the current case status is showing as “Contested – Restoration.” There has been no trial or detailed proceedings so far. A summon was issued to the opposite party, directing them to appear before the court on 31st May.However, when I inquired about the next hearing date from our advocate, I did not receive a clear response. According to the court website, the opposite party was given the next date, but the online status now shows "Contested – Restoration."1. What does this status mean, especially when no substantial hearing has taken place yet?2. Can I personally obtain a copy of the order sheet from the court without going through the advocate?

yes, you can apply for a copy before copy branch in the name of your sister and Copy of Adhaar card be attached.As per you query, the status shown as contested. it means the petitioner counsel was not appeared before the Court and the Court dismissed the petition . now the petitioner counsel file restoration application and the Court generally restore the case with cost.
