Q: Domestic Violence case, pending 3.4 lakh maintenance asking evidence

Hello, this question is regarding a Domestic Violence suit filed by my mother on her in-laws years ago, for consuming all the business property under possession and other parts of our joint property. In the case, the Interim Maintenance has accumulated to 3.4 Lakh rupees to date, but the O.Ps hasn't paid a single rupee in 1.5 years when filing execution their lawyer demanded evidence and our lawyer also agreed without demanding maintenance first. Our lawyer didnt tell us or fight them back.

hiexecution is filed within one year of the order if OP's fails to pay maintenance. execution is a separate case in that case if OP's still not pay NBW will issued against them, salary attached or property will be attached. execution case has nothing to do with the main case main case will run the way it should.

hiin mutual divorce both parties decided all the terms and conditions because court has no role to play there, court simply grants divorce if both parties agrees to each and others conditions, like alimony, children custody, visiting rights everything is decided mutually by the parties not by the court

My aunty staying separately for last 28 years from Uncle.Can she be a legal heir with uncle's son ,who is 34 years old.

hi,is your aunt and uncle are legally divorced if not then yes she is equal share holder in her husband's property like her children. no matter couple lives together or separately if they are not legally divorced they are each other's legal heir.
