विवाह के समय पत्नी को दिए गए गहने यदि पति द्वारा अपनी आय या लोन लेकर बनवाए गए हों और उनका भुगतान पति ने किया हो, तो ऐसे गहनों पर पत्नी का पूर्ण और स्वतः अधिकार नहीं माना जा सकता। यदि गहनों पर लिया गया लोन पति के नाम पर है और उसकी किस्तें भी पति ही भर रहा है, तो लोन चुकाने की संपूर्ण जिम्मेदारी पति की होने के साथ-साथ गहनों पर उसका भी अधिकार बनता है। तलाक की स्थिति में पत्नी बिना लोन राशि चुकाए उन गहनों पर एकतरफा दावा नहीं कर सकती। न्यायालय तथ्यों, भुगतान के स्रोत और दस्तावेजों के आधार पर निर्णय करता है।
