Q: Is it legal to remarry without taking divorce from the first spouse

She has been married to a person with the family pressures.But she does not want to live with him. She is saying to remarry again with me.She is not able live with him.She is saying that to going for a Arya-Samaj and to marry me.Is this the right way?

Hi client, Gdeg, u should not marry her. she ought to take divorce from her present husband. If u marry her without taking divorce u may face criminal prosecution initiated by her husband. So marry her after divorce..

Q: What should be done when petitioneris not attending the hearing

My Dad is a defendant and the Petitioner who filed the case was not present in the court( not even once ).My dad attending each time for past 3 Years ( 10 + Hearings) , What should we do to avoid this/appeal that we can only attend when Petitioner is planning to attend?

Hi Client, Good Morning, first of all , let me know about your case i.e, is it Civil or Criminal case ? and number and sections etc., Normally, in Civil Cases, Parties of the suit are not required to attend the court except some times. But the counsel represent the case of on behalf of the parties should attend. In Criminal Case , both parties should attend the court. In Civil Case , if the counsel of the Petitioner does not attend the court the judge dismiss the case after 1 or 3 defaults. if the counsel of the respondent does not attend, the judge will give order as requested by the Petitioner and against the respondent. Hi client,gone throug Ur issue, My advice is If Ur husband want to give divorce, u can claim maintenance ,if u get maintenance u no need to stay with any body..In the mean while try to get job as per Ur qualifications and think about Ur future...

Q: Husband ran away with money and not ready to take responisbility

7th year running marriage life till now no kids no family life no relation no money earnings, simply sitting at home my husband, my hard earnings theft and run away from home & Staying in hotels telling that searching for job.all ways telling lies for everything. I am not seeking for divorce right now I want to catch him and he should have fear about future never think about run away from family and hard work for family to earn money that type of case I want to file in court.pls help me now what I have to do? Dear Client, first of all give a complaint on your husband and on his family members who were involved in this to the nearest Police Station with all proofs/evidences which are available with you. Police will book a case under related sections and catch that person. The police can move the case to the court and the court will give an arrest warrant etc.,

Q: Is accepting additional dowry an offence

Demanding additional dowry is crime. Where as accepting to give an additional dowry by father in law is an affence or not

Dear Client ,Penalty for demanding dowry.- If any person demands directly or indirectly, from the parents or other relatives or guardian of a bride or bridegroom any dowry, he shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to two years and with fine which may extend to ten thousand rupees: Provided that the Court may, for adequate and special reasons to be mentioned in the judgment, impose a sentence of imprisonment for a term of less than six months.
