Q: Change in order of ownership in DOA

Can 2nd owner in sale deed become 1st owner in deed of apartment for rwa membership in multi story housing complex.

Whether a subsequent purchaser (2nd owner) can be treated as the “1st owner” for RWA membership depends upon the bye-laws of the Resident Welfare Association and the terms of allotment of the apartment. Generally, the original allottee remains the first owner in the chain of title, and a person who purchases the flat through a registered sale deed becomes the subsequent owner. The RWA cannot arbitrarily alter the ownership history recorded in title documents.However, for the purpose of membership, voting rights, maintenance records, and representation before the RWA, the current registered owner is ordinarily entitled to be recognized as the member, irrespective of whether he is the first or second owner. If the RWA records describe the present owner as the primary member, it does not change the legal chain of ownership reflected in the sale deeds.

यदि भूमि वास्तव में आपकी निजी एवं स्वामित्व वाली भूमि है, तो सामान्यतः पड़ोसी को आपको अपनी भूमि के उपयोग से रोकने का अधिकार नहीं है। तथापि, आप अपनी भूमि का उपयोग इस प्रकार नहीं कर सकते जिससे सार्वजनिक स्वास्थ्य, पर्यावरण या पड़ोसियों के अधिकारों को हानि पहुँचे।यदि कूड़ा-कचरा रखने से दुर्गंध, प्रदूषण, मच्छरों का प्रकोप, स्वास्थ्य संबंधी खतरा या अन्य प्रकार की Private/Public Nuisance (उपद्रव) उत्पन्न होती है, तो प्रभावित पड़ोसी सक्षम प्राधिकारी (नगर निगम/पंचायत/प्रदूषण नियंत्रण विभाग) के समक्ष शिकायत कर सकता है तथा आवश्यक होने पर न्यायालय से निषेधाज्ञा (Injunction) भी प्राप्त कर सकता है।अतः केवल इस आधार पर कि भूमि आपकी निजी है, आपको असीमित अधिकार प्राप्त नहीं हो जाते। यदि कूड़ा-कचरा रखने से किसी कानून, स्थानीय उपविधियों या पड़ोसी के वैध अधिकारों का उल्लंघन नहीं होता, तो पड़ोसी आपको रोक नहीं सकता; परंतु यदि इससे उपद्रव या स्वास्थ्य संबंधी समस्या उत्पन्न होती है, तो वह कानूनी कार्रवाई कर सकता है।निष्कर्ष: निजी भूमि पर कूड़ा रखने का अधिकार पूर्ण नहीं है। पड़ोसी तभी कानूनी रूप से रोक सकता है जब उससे उपद्रव, प्रदूषण या सार्वजनिक/निजी अधिकारों का उल्लंघन सिद्ध हो।

Yesterday a constable came near me on road side and i was standing near my bike and he made challan for helmet and driving licence and some other things the only thing is our bike's rc was expired in 2020 . They made 33000 thousand and impound tha bike what should i do now

From the facts stated, the legality of the challan and impounding of the vehicle depends upon the specific violations mentioned in the challan. If the Registration Certificate (RC) of the vehicle expired in 2020 and was not renewed, the authorities may impose penalties under the Motor Vehicles Act and may also impound the vehicle in certain circumstances. However, if you were merely standing near the motorcycle and not actually driving it at the relevant time, that fact may be relevant to challenge some of the alleged violations.Obtain a copy of the challan and seizure/impounding memo, verify the sections invoked, and check whether the penalties have been correctly calculated. You may get the RC renewed, arrange valid insurance and other required documents, and apply for release of the vehicle before the competent authority. If the challan amount appears excessive or unjustified, you can contest it before the concerned Traffic Court/Magistrate. My small brother in-laws gave my mother an gold chain and my mother was also used to live with them only. Now after her death without any will. they are saying this chain was given by my in-laws and I will keep it without distributing it. Can they legally keep it.

No, they cannot legally keep it to the exclusion of other legal heirs. If the mother has children, the gold chain must be distributed equally among all her children and her husband (if alive).If they refuse to return or distribute the property, the legal heirs can file a suit for recovery of movable property or seek a Succession Certificate from the relevant civil court to establish their legal right to the deceased's assets
