Hello,greetings! My brother has been under the police custody for a 420 allegedly charges at the dasna jail in ghaziabad, since September 4th 2018. He was arrested in Delhi and so far we have hired three different lawyers from Delhi to help us in getting bail for him,yet non has been able to do that ,after collecting money from us. The case hasn't gone to trial yet, the charge sheet has been out since last year,and the session court has also denied bail last year too. We want to get a reliable and trustworthy criminal lawyer from the allahabad high court this time, to help us get bail for him.. You may contact Mr. Gopal Chaturvedi, Mr. VP Srivastava, although alongwith being good they are most expensive also.Further you may contact Mr. Rajiv Lochan Shukla(my former senior), Mr. Pulak Ganguly or Mr. Rahul Sahai. They are also good and are comparitively less expensive.However if you can spend something between 1 lac to 1.5 lac then Mr. Gopal Chaturvedi is undoubtedly the best criminal lawyer in Allahabad High Court. Q: I want divorce because she is cheating on me

My wife had a relationship with someone before marriage. I got married in 2015 with her. She has been talking with him on mobile since marriage. I have some call records. You may file a petition under Section 13(B) of Hindu Marriage Act if you are a Hindu and git married according to Hindu rites. The ground that you may take for divorce is that of adultery.The court will also try that you reconcile your dispute and will give you time for the same but if the reconciliation is not possible after that decree of divorce will be issued. The ground will be adultery.



Q: Illegal construction but Registry done

Hi, I purchased a flat in Indirapuram Ghaziabad. This is a multistory builder flat. When we purchased we simply thought if the registry is done that means it is legal and in registry it clearly specifies the area and design of the flat. We somehow missed on looking at the layout of the building S=since the registry was done, Bank approved the loan by scrutinizing every corner of the flat, etc. Now we got a notice that only 8 flats were approved and the builder constructed 16 flats in that premise. Though the area of the building is intact it was supposed to be 8 flats, not 16. This is just a year old building. Please tell me as a customer what we can do in this case. This is a builder fraud and government ignorance when the registry was done and also, why they didn't check all this before when the builder was actually building 16 flats instead of 8.

Hi, you can either approach Rera or Consumer Forum. Alternatively you can also file a criminal complaint under Section 420 IPC. However, going through Rera or Consumer Forum will be a speedy remedy. The builder is coming under the purview of representation and hence he has acted in contravention of both ReRa and Consumer Protection Act. Hope this helps. Q: To get the right in property of my Late Husband after my remarried.

Dear sir/madam I'm 23 yo woman from Mathura, i was married with Amit Kumar (Agra) on feb 14, 2014.I have two daughters with him. Unfortunately on 25th January 2017 my husband got expired in a car accident. But i continued living in his house with my two daughters and mother in law. My mother in law had two children including my late husband and one married daughter. After 2 yrs of the death of my husband on 08.03.2019 my mother in law remarried him with a guy of her knowledge (she told to addopt him but she didn't it legally) after my remarried me and my husband along with my two daughters and mother in law lived for two months in my ex husband's house. Now my mother in law throughout me and my husband with my daughters saying that you don't have any right on your ex husband's property. Please help me, what are my legal rights on my ex husband's property.

You are entitled to property even after remarriage. There is a judgment of the Supreme Court in the year 2008 which has held that even after remarriage a widow is entitled to the property of the deceased husband. Hope this helps.Regards

Hi,You can file a case for cheque dishonour under Section 138 Negotiable Instruments Act after serving a notice to the concerned company. Consumer case can only be filed if there is a deficiency in any service provided by the company.Alternatively you can initiate Insolvency proceedings against the company under the Insolvency and Bankruptcy Code.Regards.
