Aapke prashn se ye spasht hai ki aapko FIR ki copy aur bail application ki jankari chahiye. FIR ki copy aap sambandhit thana ya court se le sakte hain. Bail application ke liye aapko magistrate court me apna application file karna hota hai, jisme vakil ki madad lena sabse uchit hoga. Agar matter cyber crime se related hai to sabse pehle FIR register karna avashyak hai. Uske baad hi bail ya anya legal action ki process ki ja sakti hai. Kripya apna query thoda aur clear tarike se bataye taki aapko sahi margdarshan diya ja sake.
Q: Want to transfer undivided share in partnership firm
XYZ is a partnership firm runs a petrol pump business in Haryana and A, B,C & D are four partners in the firm with each holding equal share. Now here C wants to transfer his undivided share in the firm to D, but other partners don’t want D to get into 50% share. D’s main motive is to get into 50% profit share now and surplus assets after dissolution and settlement. As C is just a Dummy partner of D ( in actual D is investor of C)Do section 29 of partnership act supports here
Advocate Ankit Sharma answered
As per Section 29 of Partnership Act, a partner can transfer his share to another person, but that person does not automatically become a full partner in the firm. For becoming a partner in management, consent of all existing partners is necessary. So, if C transfers his share to D, D can only get the right to receive profit from C’s share but cannot take part in business decisions without consent of A and B. Therefore, D cannot directly claim 50% share or control in the firm.

Q: i want to know my arrest is illegal or legal. can police do it
i was in jail in another case. poilce moved to the court and get a production warrant against me related to other FIR. but that pw was not executed, and the issuing cjm of pw then has given a order that i am not needed in the court. so i got released because of court this order, jail authorities relased me after receiving this order, now police came to my house without any court warrant or knowledge and direcly arrested me. so can police do it, is it legal or ilegal
Advocate Ankit Sharma answered
Police can arrest an accused without warrant if the offence is cognizable under CrPC. However, if the court has already passed an order that your presence is not required through production warrant, then direct arrest from your home without showing any warrant may be challenged as illegal. You should immediately move an application for bail and also bring this fact to the notice of the Magistrate. If police action was without due process, you can also file complaint against such arrest.
Q: Received notice for divorce by husband,fIR by wife was already filed
I had received notice on 11.11.2024 by husband for divorce u/s 13(1)(ia)(ib),of H.M.A., to appear on 13.03.2025, for reply, I had submitted me reply on 13.03.2025 including that d.v. and FIR chargesheet already filed against husband. Now the next hearing is on 05.09.2025, (status showing written statement in ecourt app), can I (wife) submit evidence to support my reply? I don't want mutual divorce but want justice first., because my husband and his family has fraudulently looted 30 lakhs from me
Advocate Ankit Sharma answered
Yes, you can submit documents and evidence in support of your written statement. The Family Court will give you full opportunity to lead your evidence at the stage of trial. Since you do not want mutual divorce, you should clearly contest the petition and prove your allegations of cruelty, fraud and financial loss. Keep all proofs like FIR, charge sheet, bank records etc. ready and file them through your lawyer.
