yes you can send him legal notice if he is not help to file for mutual divorce .before this you should file case of section 9 of Hindu Marriage act 1955.Along with you should apply for your mentinence .

Q: In-laws Misbehaving With Me and Family

its been about 5 years of my marriage but my in-law always misbehave with me.It happens when my wife goes to in-laws home and we call them to send my wife back they started counting excuses and then they are always be ready to fight us.I have a 8 month old daughter this time. My wife is at in-laws home because here grand mother is expired before 20 days approx.Yesterday we have called my in-laws to send my wife back on this weekend but they said they have some important work till monday than I said to send her on tuesday and then they have stated saying that your mother -father will not expire and shouted on my mother too.In afternoon my brother in law came at my home started upside down to my mother even he was too angry to beat us.This is very embracing situation due to so much of insane with us.I am also worried about my daughter she is only 8 month what will happen with her, custody all please help

you should file petition for divorce on the ground of cruelty according sec13 of Hindu Marriage law. you can also charge your in- laws for 349,350and 351.you can get the custody of your baby but you should prove a legal justification before it



Q: Can I file divorce petition as a husband without paying alimony ?

I got married 2 years back. It was not working between us. She planned to take me and my family under her control using black magic, about which I got to know via call recordings which she used to plan with her family (I.e. my in laws). Since last one and a half year we are neither living together, nor we are in any contact . They have not even initiated to find the solution for the same, even when we wanted to mutually solve it . We even got to hear that they are planning to stuck this marriage for coming 6 to 7 years and then demand the compensation by betrayal. So how can I file a divorce case in this consent ? It is the situations of mental cruelty. you Can file a pitition for judicial separation according to sec10,or for divorce sec13of Hindu Marriage act 1955.you have a another ground of desertion for divorce after 6 month. (As you say that you are not living together since last one & half year )
