Questions Answered by Advocate Dinesh Chandra Joshi

Q: Seeking advice from Respected lawyers

I am an adult (33yrs old) female. I met an army officer through tinder in may 2020 . He proposed me after few conversations. But we never met in person. Just audio video chats. I never trusted him . He tried to convince me that he loved me. In 2021 april i got covid infected. He took great care of me through phone. He asked me if i am willing to marry him. He again and again asked me to come and meet him so that we can take the conversation further and get married soon. We met for the first time in June 2021. He said he wants to marry me and would like to speak to my parents. I was overwhelmed. The same night we got drunk and we had sex. I was convinced only because of his fake marriage promise. He repeated the same things till November. Now when i speak of marriage he asks me to stay casual. He says he is not interested in getting married now. I even doubt whether he’s single or not. I am a victim. How to proceed. I do not have any chat backup or proof Other than the hotel record.

Advocate Dinesh Chandra Joshi answered
first of all warn him that you want to help by polish, then show his reaction,if he agree with you regards marry to you then no problem but if he not agree to you then you need to help by police..The other way that sand a latter to his army unit that what happened with you and ask to his unit officer that how your unit will help to you .

Q: How can I get residential order from court to stay in marital house

I am living with my parents presently.my husband filed for divorce n in sec 9 which he himself filed before denied to stay with me .Now he want divorce n not giving me residence to stay .How can I get residential order from court to stay in marital house.presently he stay in rented house out of city and his parents have their own house .

Advocate Dinesh Chandra Joshi answered
It is to good for u if your hubby filed both cases diverse and sec.9.. Because filing with sec .9, diverse case is not maintenable..u file out domestic violance case to your husband and his parents too..because may be your marital house is your father in laws house ..in this case ,if u make the case partee only your husbby, then your demand to live in your marital house is not mainenable...so contact your nearest domestic violance cell to take action to your husband and his parents in domestic violance case..because in the Law of protection from domestic violence ,there is provision to give saprte room to any women in any faimely house who suffer from domestic violance by hir husband or his paresents...kindly see sec.17 and 19 with sec 2-Q of Law of protection from domestic violence of women -2005.
