Questions Answered by Advocate Aditi Tripathi

Q: For Judgement Delay In Civil Court

Civil case class A .. mai judgement mai kitna delay ho sakta hai ? mere case mai order 6 September ko aane wala tha lekin 6 sept, 18 September, 6 October ye peshiya vaadi ne badhwa di , fir vaadi ne kuch case law diye fir 28 October ko peshi mai prativadi ne case law diye fir judgement ke liye peshi rakhi gayi 17 November ki lekin vo badha di gayi usko 20 November kar diya gaya fir 20 ko bhi badha di gayi usko 27 November kar diya......aise mai aadesh kab tk aa sakta hai??

Advocate Aditi Tripathi answered
Normally judgment should come within 30–60 days after arguments conclude.Since the case is already listed multiple times, it is expected very soon unless unforeseen administrative reasons cause further delay. If delay persists after 27 November, we can formally request the court for early judgment.

Q: Three Brothers joint owner, elder brother keeps entire profit with him

We three brothers are joint owner of agriculture land in Chhattisgarh, elder brother's name appears first. He sales entire paddy and other produce and sale amount is credited to his personal Bank account and does not share anything with me. Cost od paddy in open market is 2300 Rs per quintal where as society buys the same for 3100 quintal, he keeps entire profit with him , we are Hindu. Please advise

Advocate Aditi Tripathi answered
As per the facts stated by you, the agricultural land in question is joint family property, jointly owned by you and your two brothers. Since it is ancestral/joint property, all co-owners (coparceners) have an equal right, title, and interest in both the land and its produce. If your elder brother is selling the entire agricultural produce and crediting the sale proceeds solely to his personal bank account without accounting for your share, such an act amounts to wrongful appropriation and denial of your co-ownership rights. Appropriate legal steps (beginning with a notice and, if required, a partition suit) can be initiated to protect your rights. For more enquiry you can contact me.

Q: SCHOOL MOBILE CONFISCATION AND PENALTY

On Children's Day 14th Of November I And Some Students Brought Mobile To School thought it was a special ocassion to click memories , but school confiscated the devices and saying without 2000 rs fine we will not give it back to you it's a CBSE Affiliated school and it's not mentioned that 2k should be charged for mobile anywhere.

Advocate Aditi Tripathi answered
Since the school is CBSE-affiliated, it must adhere to CBSE’s rules and its own published school policies. If the rule regarding a ₹2000 fine for mobile confiscation is not mentioned anywhere in the school’s code of conduct, circulars, or prospectus, the school cannot legally impose such a penalty arbitrarily. You may first write a formal representation to the school principal requesting the return of the mobile without fine, citing that there was no prior notice or rule about the penalty. Mention that the mobile was brought on Children’s Day for capturing memories, not for misuse. If the school still refuses, we can approach the District Education Officer (DEO) or the CBSE regional office with a written complaint about the unjustified monetary demand and violation of CBSE’s disciplinary guidelines.let me know if you need any further legal help.

Advocate Aditi Tripathi answered

Q: Medical consultation from residence

I am a retired Gynaecologist residing in Chhattisgarh. I would like to open a consultation room in a corner room of my standalone bungalow. Can you inform me on the legal requirements, if any, in starting the consultation room. I intend to just examine the patient and go through the reports and offer advice. No procedures will be done in the Consultation room. There will be no staff other than me

Advocate Aditi Tripathi answered
You may open a consultation room in your residence after informing the local Municipal Authority and ensuring zoning compliance. No separate registration is required under the Clinical Establishments Act if only consultation and examination are done without staff or procedures. However, display your registration as a medical practitioner and maintain basic hygiene and record-keeping standards.
