If my home wall if fell due to neighbour construct a wall in his land .In the rainy my wall is leaking and fell down .how can I take a action on him .

Regarding the problems you mentioned you can avail following legal actions against your neighbour:-1. Give a legal notice to you neighbour to compensate your lossess in some days(7 days or 15 days as required ) ignoring which shall lead to the appropriate legal action by you against him.2. After giving legal notice engage a civil engineer or architect and obtain a technical report describing the real cause of breakdown of wall that is your neibour's action. Also keep along with you the photographs and videos related to the condition of wall before and after falling.3. File a civil suit for damages and injunction to prevent the neighbour for doing such harmful construction.

If your has not been arrested till yet we can file the application of anticipatory bail in session court or High court . We can also file the application of quashment of FIR in the high court under section 528 of Bhartiya nagrik suraksha sanhita, 2023. If you wish to go with these solutions some solid reasons are required for non involvement of your husband in the said matter.
Q: No Record of Ancestral Property with Revenue Department
In 1927, 500 acres was purchaesed by my family ancestors. We have challan, DC and Zamindar letters, forest officer possession letter, and 1966–69 forest dept. clarifications stating it’s not govt. forest land. Till date, Revenue dept. (RTI) confirms no record exists. Now locals are cultivating without rights in a portion of it. We seek legal aid for notice and declaratory suit.

First we have to conduct an enquiry for the status of the said property in Adhikaar abhilekh which is the oldest relevant source to know the status of a property. After that we have to compile the documents in your possession and the documents received by conducting due diligence and then file a civilauit for declaration of title making state government a party therein.

Properties are of 2 kinds, first ancestral and second Self auquired. You can claim rights on your ancestral property by virtue of succession. In your case as your father is no more, you can claim your right in that portion of your ancestral property Grandfather's property which would be inherited or received by your father if he would have been alive. In my opinion if you family members are in determination to ruin you rights then you can approach to the concerned civil court and file a partition suit therein with producing all the relevant documents depicting your ancestral property and you can pray to the court to partition your share from the property of your undivided family and a consequential remedy you can pray for an order to the revenue authorities for maintenance of land record in compliance of such order.

एक मकान है आबादी भूमि पर जिसका पंजीकृत बंटवारा हुआ है , राजस्व रिकॉर्ड में जिनका नाम दर्ज था उन्हीं 3 पक्षों ने बंटवारा किया है । बाद में 3 पक्षों में से 1 पक्ष के पुत्र ने केस किया है कि उसकी बिना अनुमति के बटवारा हुआ है उसका नाम नहीं है बंटवारा में लेकिन उसके पिता की मृत्यु के बाद जब प्रॉपर्टी उसकी मां के नाम पर नामांतरण से दर्ज हुआ तब उसने कोई आपत्ति नहीं की , मौन सहमति दी और उसी के जरिए जिन 3 लोगों का नाम राजस्व रिकॉर्ड में दर्ज था उन्हीं ने आपसी सहमति से पंजीकृत बंटवारा कर लिया है । बंटवारे में ना किसी का नाम जोड़ा गया है ना ही किसी का नाम काटा गया है सिर्फ मकान का 3 भाग करके पंजीकृत बंटवारा किया गया है । इसमें कुछ गलत हुआ है क्या ?
