What to do when a false dowry case has been filed against you
It is a well known fact that dowry laws are more favourable towards women. Thus, to avoid abuse of such laws by your wife, you must take the following precautions:
There are two kinds of situation that may arise:
i. When your wife threatens you to file a false dowry case, you must check the following:
No dowry case can be filed, if your marriage has completed 7 years.
Avoid any acts that could harm your wife and can be used as evidence against you.
You must collect evidences against your wife, that she is threatening you with such false accusations.
You must file for an anticipatory bail in the sessions court to avoid arrest.
ii. When your wife has already filed a complaint against you:
If she makes a false complaint, the police will not file an FIR immediately.
The complaint is first forwarded to the women cell so that both the parties can reach a compromise.
If you and your wife are unable to reach a settlement, you will be directed to go for mediation or conciliation in a district court.
In case the above procedures fail and an FIR is filed against you, file for an anticipatory bail immediately.
If you are willing to end your marriage, you can file for a divorce based on any grounds as per your personal laws.
