Steps for Mutual Consent Divorce


If you and your spouse decide on similar terms and conditions with respect to maintenance amount, property division and child custody, then you both can file for a mutual divorce.

You and your spouse must check the following essentials before filing for a divorce by mutual consent-
  • That you and your spouse have been living separately for a period of at least one year
  • That you both have not been able to live together, and
  • That you and your spouse have mutually agreed that marriage should be ended.
  1. Joint petition must be filed by both of you in the Court.
  2. It should be signed by both of you.
  3. The court shall then record your statements which you must sign.
  4. A period of 6 months is given to re-think, in case you and your spouse change your mind and wish to re-unite.
  5. At the end of 6 months, if you and your spouse still want to go ahead with the divorce, then the final hearing shall take place in the court.
  6. After this final appearance is made, the Court will grant the divorce.
