The process of changing one's name is accompanied by numerous personal, social, and legal consequences. The process of name change includes the filing of an affidavit, an advertisement in the newspaper, and a publication in the Gazette. The process of changing one's name in India involves an overall approach to dealing with the consequences that a person is likely to face when they change their name.


Step-by-Step Procedure of Legally changing Name in Mumbai

A person must follow the steps below to legally change their name in Mumbai:

Step 1: Prepare and file a Name Change Affidavit The affidavit for change of name is a document of affirmation or swearing that confirms the identity of the person who has to change their name. The & lsquo identity' here refers to the former name of the person and the name one wishes to transition to. This Affidavit can be attested by an Advocate SEM, a Judicial or Executive Magistrate, a Notary Public, or an Oaths Commissioner. If a person wishes to change their name in Mumbai, or anywhere in Maharashtra, the draft Affidavit must be printed on a stamp paper of the suitable domination, which is Rs. 20 in Maharashtra. It is important to use stamp paper of the appropriate denomination or the Affidavit will hold no value. In the name change Affidavit, the person looking for changing their name must provide their previous name, new name, and their current address. The reason for changing the name along with the age of the person must also be mentioned.

Step 2: Posting the Name Change Advertisement in Newspapers Posting an advertisement or notification in the newspaper is a formality in the process of changing one's name which ensures that the change in the name is declared publicly. To present the change in the public domain, the advertisement must be made both in a regional language newspaper of Mumbai, i.e., Marathi, and an English Daily. A newspaper requires the following details to post a name change advertisement:

  1. Old name,

  2. New name,

  3. Parent's or husband's name (if the change in the name is after marriage),

  4. Address,

  5. Date of the Affidavit, and

  6. Name of the person who attested the Affidavit.

Step 3: Publication of Notification in the Gazette A notification in the Gazette is published both at the State and National levels. A government-employed person is required to submit the relevant documents to the Controller of Publications and can have their name changed. A resident of Mumbai willing to have their name changed can easily do so online through the digitized process. The documents required for the E-Gazette are as follows:

  1. An ID Proof: PAN Card, Aadhar Card, Voter ID Card, or Passport with the old name,

  2. Address Proof: Electricity Bill, Aadhar Card, or Ration Card, and

  3. A recent passport-sized photograph.

In case a woman intends to change her name after marriage, a copy of the Marriage Certificate along with the abovementioned documents must also be submitted. A person can legally change their name through the official website of the Maharashtra E-Gazette Notification by scanning and uploading the documents. The status of the application can also be checked through the website.
