Q: Husband wants to take me back after filling 498a n maintenance case.
I have filled 498a after a month of abuse in my new marriage. My husband asked money for car and was constantly mentally torturing me ,saying names and on my character. Later filled maintenance. Now after filling case they are asking me to take back home but I don't want to take case back. What should I do. My Marriage is already broken after all this mess n don't want to suffer that same thing again ever. My husband is very arrogant and I know he is says this just for case sake. He has also texted me once that I was not capable of being a wife or gf. Regarding car he said it was just a discussion. But now he is not even asking for divorce. I can not ask for divorce coz my lawyer said it will effect my case and husband will backfire saying I filled false case to get a divorce. Plz help I don't want to suffer again and I don't imagine my life with this man anymore.

carry one your case when he will come for bail then put ur proposal for divorce. court will send the matter to mediation where u can put ur proposal for divorce. but prior to divorce try to solve the matter if possible. it is not guaranteed suppose u marry another guy he may me more cruel and arrogant.

There is provision for mutual seperation but there should be no second marriage without divorce as per Hindu law and bigamy is punishable u/s 494 of IPC and in muslim law a woman is not allowed to do second marriage
