Questions Answered by Advocate Vishwajit Kumar Singh

Q: Bank is aking for revised PPO from Department

in my husband Office my name is mentioned as Renu (without Surname) as per service record. After my husband got expired in Sept 2025 I shared his Death Certificate with Bank (Bank shares it with Deptt). Deptt issued PPO in June 2026 (after 9 months) stating only my first name. Bank A/c is a joint account of my husband and myself which has first name & surname. From past 2 months bank is pressuring me to get revised PPO from husband Deptt containing surname also. Pls advise the solution.

Advocate Vishwajit Kumar Singh answered
Raise the query regarding your name mistake through sparsh portal and the same may be corrected as per the record held by the concerned Department. Onces the name will be corrected the Corrigendum PPO will be issued.

Q: What correct procedure for summons to USA

judge issue summons. My advocate tell me he going to summons defendant who living in Ohio, USA via email. I not sure service by email overseas allowed. I need second opinion to know what is proper procedure for USA resident.

Advocate Vishwajit Kumar Singh answered
If the defendant is living in the USA, the court may order service outside India under Order V Rule 25 and Rule 26. Since both India and the United States are parties to the Hague Service Convention, summons are commonly served through the Convention. The Indian court forwards the summons through the prescribed channel (usually via the designated Central Authority), and the U.S. authorities arrange service in accordance with U.S. law.

Q: Road Accident 3 months ago.. No FIR yet. Now asking for 5-6 lakhs comp

A road accident involving my car occurred in Delhi about 3 months ago, causing injuries to a motorcyclist. No FIR has been registered till date. The injured person initially gave a written statement declining an FIR but is now seeking ₹5–6 lakh privately. I have valid third-party insurance. Can the claim now proceed through insurance? Is an FIR mandatory or will a DD/GD suffice? What is my best legal option? Settlement out of court?

Advocate Vishwajit Kumar Singh answered
Since your vehicle was covered by a valid third-party insurance policy on the date of the accident, immediately inform your insurer (if not already done) and cooperate with any investigation. Avoid making any private payment of ₹5–6 lakh without a properly drafted written settlement, as such payment may not discharge future claims and may prejudice your legal position. If the injured person is willing to settle, the settlement should preferably be recorded before the MACT or through a legally documented compromise to ensure finality. If no settlement is reached and criminal proceedings are initiated later, seek anticipatory/legal representation promptly and preserve all documents relating to the accident.

Q: 18m married forcefully, and now being blackmailed for extorting money

Hi, i am 19 m, got forcefully married last year to 24f, she is mentally unstable, and her family is asking 15lakh rupees to settle or they will file fake cases. I am filing annulment under hindu marriage act, as i was a minor, what will happen if i file annulment, and they file false 498a, dv, and cruelty? Can we get arrested?

Advocate Vishwajit Kumar Singh answered
If you file for annulment as a minor, the marriage will be treated as voidable, and once annulled, Section 498A (cruelty by husband/relatives) cannot legally apply because there is no valid marriage. However, if the other side files false cases (498A, DV, dowry), you may face investigation, but immediate arrest is unlikely due to Supreme Court guidelines requiring police to follow safeguards before arrest.Under Section 12(1)(b) of the Hindu Marriage Act, a marriage can be annulled if the spouse was of unsound mind at the time of marriage, making them incapable of giving valid consent or of leading a normal married life.Once annulled, the marriage is treated as if it never legally existed.
