Q: I am confused to buy a house or leave it

My brother has self-interest in his property buy no rights to sell or gift it. It was transferred to him by my father gifted him and also mentioned the above conditions to not to sell or gift, only u have self interest Now my brother made a gift deed on his wife's name and trying to sell it to a third party on her name as a younger brother me what action I should take? Pls suggest.....

Since your father’s gift deed gave your brother only life interest without right to sell or gift, the gift deed he executed in favour of his wife is void, so you should immediately file a civil suit for declaration and permanent injunction along with an interim injunction petition under Order 39 Rules 1 & 2 CPC to restrain further alienation, and also submit a representation to the Sub-Registrar attaching the original gift deed to prevent any illegal registration in favour of third parties.

Q: Quashing a case through General Power of Attorney

Hello I want to file for a quash petition but the complainant is not available in India. They want to cancel it through power of attorney. My section is 69 BNS. Please let me know what are the possible scenarios of how can I quash the case successfully.

A quash petition under Section 482 CrPC must be filed by the accused, not the complainant; since your case is under Section 69 BNS (cheating by personation, compoundable with court’s permission), the safest route is to obtain a No Objection/Compromise Affidavit from the complainant abroad, duly attested by the Indian Embassy, or have them execute a Special Power of Attorney authorizing someone in India to state their consent; with this, the High Court generally quashes the case on settlement grounds, but if the complainant is uncooperative, you can still argue that the FIR/charge sheet lacks ingredients of the offence and seek quash on merits.

Before buying land, you should apply for an Encumbrance Certificate (EC) for 30 years from the Sub-Registrar Office to know registered dealings, verify revenue records (1-B, ROR, Pattadar Passbook, tax receipts) at the Mandal/Gram office, check for any pending civil or criminal cases in the eCourts portal and Telangana High Court website using the owner’s name or survey number, make local enquiries with the VRO/Panchayat/neighbours, and finally take all documents to an advocate for legal opinion to ensure the property is free from disputes before purchase.
