Questions Answered by Advocate T Jeevitha

Q: Ancestral Property issue what to do

My Father`s grandfather bought a land and after he died it came in the hands of my grandfather. Later in 1990 my grandfather registered the land in my grandmother`s name which was not known to my father who was major at that time. Later in 1991 my grandmother sold that land without my fathers permissions since we were not in contact with her. My Grandmother died recently 2017 November so just now we came to know about that .so is that possible to claim the land since it is my father`s ancestral property and not bought by my grandfather or grandmother.

Advocate T Jeevitha answered
Yes! It is possible to claim, because this is ancestral property, if your father owned the property by his own fund means, you cannot claim as you will be not eligible for the same, but it is an ancestral property so you can claim and you have the absolute right to claim. But you should have the valid reason to claim, for an example 1. If you don’t have any proper knowledge about the property 2. If you were not in station for last few years. 3. from the date of attaining maturity within 3 years you can claim the property as per Limitation Act.
