Hi, the original complainant (son) has passed away, but now his mother wants to continue the case on his behalf. Is there any time frame to reopen the case, and can a case be reopened after 10 years or 20 years if it was previously closed in India?

Yes there is a specific time frame for that. Not more than 90 days. After that if u can prove the delay reason to the satisfaction of the court. Then she will added up as a party of the case and she can continue with the case. But in criminal case that is not possible.

To withdraw a POCSO Act case, the only legal option is to settle the matter between the parties and then file a Criminal Miscellaneous Petition before the High Court for quashing the case. The trial court does not have the power to withdraw a POCSO Act case. The POCSO full form is Protection of Children from Sexual Offences Act, and its provisions are very strict, making withdrawal extremely difficult.

Out of the total court fees the 1/10th is to be paid along with the filing of the suit and the remaining is to be paid before the trial starts. That remaining court fees is said as balance court fees
