Questions Answered by Advocate Sanjeet Kumar

Q: Can my mother receive her share of father's property

My mum's brother lives in Australia and upon death of my mum's father, he got the property under his name and is now sole and absolute owner of the property. He initially kept saying to my mum that he will transfer 50% share but now is intentionally delaying and refusing. My mum's father had unregistered will only. Can my mum get her share of property if my brother deceitfully transferred property in her own name? My mum's father's property is self acquired?

Advocate Sanjeet Kumar answered
Definitely your mother have a right in the property of her father. You can make a complaint to the police station and can file a case against your maternal uncle for the share in the property. If her mother is alive, she also has a right

Q: Husband abandoned kids & me in USA.filed case in India 4 child custody

Hello nMy husband has abandoned us(me and my kids in USA) after abusing us. We are Hindu Indian, Immigrants in US. Now when he got call from US regarding offence he did, he filed child custody case in Gurgaon, India. Police case is done in my favour.I have a question. Do I have to contest the case in India. Do I have to contest at all as kids are in US from last 5 yrs. I don’t have enough finances to even hire the lawyer in India. So asking. He filed a case in Jan 2022 after abandoning us in Oct 2021. Kindly suggest. What options I can avail.

Advocate Sanjeet Kumar answered
If ur financial position is weak then you may get an advocate from legal aid panel on government expenses but you can lose the custody of the child on this ground alone. So u have to hire a private advocate for which u have to pay. In India huminity is still alive and if ur luck help, you can have a lawyer on nominal charge

I am adult(21) and unmarried. If i have a married man as my boyfriend, is there anything illegal against both of us ?

Now he is backing out and started dating another woman. He is no agreeing to our secret marriage as well. What can i do to take legal action against him? Is this a punishable offence?
