Q: What are the tax implications if I want to sell property ?

I plan to sell my property which I acquired 4 years back in Thane .I bought this propert for 95Lakhs +8 Lakhs fro registration etc. The current selling price is 1.05 Cr for the house alone. I want to use the proceeds for buying land in Hyderabad and invest 40 Lakhs in something.. This is my only house and I am currently working with an annual gross income of 20lakhs. I want to know the tax implications on above . I am Hindu.

This is a long term capital gain theory. You need not have to calculate gain and to pay any tax on it, If you invest entire proceeds either 1. Capital gain bonds in 180 days from the date of sale deed.2. If you buy a new flat in 12 months from the date of sale deed. 3. If you construct the resd house during the 3 years from the date of sale deed. If you does anything of the above and invest entire proceeds then you need not have to pay any long term capital gain tax on the sale of your "only house". Otherwise you need to pay the tax on the followingSale price of the house - Indexed cost of acquisition (including regn charges) = Long term capital gain.



Q: Is divorce necessary for marriage not registered

My wife wants to divorce me after a whole year of mentally torturing my family and me. We don't have a marriage certificate and I will deny to sign the divorce papers. Please advise

Yes, assuming you are Hindus, You can file for divorce under section 13 of the Hindu Marriage Act. One option available to you is filing for divorce by mutual consent, if your wife also agrees to the divorce.

Yes, Mutual Consent Divorce is a simple way of coming out of the marriage and dissolve it legally. Important requirement is the mutual consent of the husband & wife. There are two aspects on which Husband & Wife have to reach to consensus. One is the alimony or maintenance issues. Next important consideration is the Child Custody.



Q: Advice in case charged for cheque bounce and want enough time to repay

As per subject i got a notice from payee and I did not attend the three consecutive dates i wont be able to pay their 2lakh in coming 4 days only but i i have 4th court date tom where i will get arrested. please guide

Once the summons issued the offence u/s 138 is got registered. So by escaping to attained the date will/may double the offence. Its out of question to make any payment after issuing the summons. As Hon court has got convienced prima facie. So in my view you attained the coming date with proper bond and then put the facts and compramise proposal prior to fixing of the charge and witness examination.
