Q: Rights of second wife on property in name of deceased first wife

My mom expired in 2012 then my dad expired in 2018 .we are the only 2 daughters of our parents.my dad has left a second wife with no kids from her.we are muslims.the house which our parents use to leave is on our mother's name.my question is that do we have the sole right on that house.what is the right of our stepmom in our mother's properties and father's debts and properties

Hello my self Adv.sagaryedke As per your question that property dispute in between you and your step mother, that there is no any right of your step mother in your original mother property.and the second thing is that you have full right in your original mother property and it's only up to legal heir's certificate from Court ,as per Court order you can do anything with that property.



Q: Booked flat in 2011 project not started and builder commited suicide

I booked flat in 2011 in titwala area.My builder committed suicide in march2018.And the land in which the flat was to be constructed is auctioned by KDMC for Open land tax.How i can get my money back and what is the procedure please advise

Heloo First upon you have to collect all documents about this booked flat.after that you have to sent them legal notice and after that field civil suit against them for declaration and compensation of this flat..



Q: Person caught for drink & drive asked to be present before the court

My brother was cought for drink and drive few days back....and he paid a fine of 2000. And later he was asked to come in court ...what will happen in court ? And will he go to jail? How would we tackle this?

Helloo Drink and drive is crime but at some matter court cant punished inspite of that court can ask you to pay fine in court after this process they relief you on advanced notice. If you were not appear in court on fixed date then court can issue warrant against on you.

Can I take the help of the police to enter Husband house ? Husband beat s me and used flower pot to injure me on my hand because the food was not properly cooked ...he forcibly threw me out of the house i went 3months back ...He did not open the door ....

Heloo Mam You can do everything against your and also can take legal action against him. You can field FIR Against him any time. If police officer is not taking any report from you then you can go direct in court at jmfc level or Women's protection officer at your place..

whether the accused has to present personallly for providing document before the investigating officer on notice to the accuse of section 91of crpc if not presented what are the consequences

Summon to produce document or other thing Whenever any court or any officer in charge of police station considers that the production of any document or other thing is neccessary or desirable for the purpose of any investigation inquiry ,trial or any other proceeding under this code by or before such court officer ,such court may issue a summon's or such such officer written order to the person in whose possession or such power such documents or thing is believe to be requiring to him to attend and produced it or to procedure it ,at the time and place stated in the summons or order. Section 93 of crpc search warrant may be issued .where the court consider tjat the purpose of any inquiry trial or other proceeding under this code will be served by a general search or insepection it may issue a search warrant.
