Q: Addition of charge during appeal stage

My brother convicted in 354 and posco 7/8 for 4 years by session court .there was no allegations of rape in 161 statement not in 164 statement not in prosecution witness time but suddenly after conviction victim saying rape was also done in appeal .is there possibility of adding rape charge .no allegations of rape in first nor in 164 statement not in entire proceedings of trial.

My friend is murderd by her husband and her parents registered fir against husband of deceased under 304b and 498a and 3 eye witness(her mother father and uncle) see that he hangind her and ties her hand) mentioned in fir.I talk to deceased women 16 days before the incident. Can deceased women husband blamed me in court that any illicit relatiion of deceased have with me.
