Q: Procedure to take action in cheque bounce case

100000 rupya kisi Ko interest or diya tha uske badle me 100000 ka cheque Liya tha.cheque lagane per rupya account me nahi tha cheque dishonoured ho Gaya.kya kare?

With in cheque bounce ki date se one month se pahle aap use notice de or us se 100000 rupye ada karne ki maag kare 15din ke pahle nahe diya samay sima se pahle to aap sec 138 NI act ka mukadma dayar kar sakte h. Lakin dhyan rahe ki cause of action se one month se pahle mukadma jarror dayar kare.



Q: Wife claim maintenance under 125 CrPc & section 24 of HMA

Can wife claim maintaince under CRPC 125 if she is already getting maintainance under HMA 24 ? Is this below judgment of SC says that Prevent Interim maintainace under sec 125 if case is going on in HMA 24 https://indiankanoon.org/doc/1162687/ Please help, if this judgment could be used to reject 125 petation, i have read it but not able to undersand completely.

As for as I know, wife can not file petition for maintenance u/s 125 CRPC if she getting maintenance u/s 24 of HMA. How ever, i have not gone through the judgement reffered to by you I will find out the copy of the judgement and answers you in detail after reading the judgement.



Q: Husband file for divorce as wife doesn't want to live with husband

My wife is not happy with me because she want to live with someone else she love . So many times she fight with me and my family . And she always run to leave me . But whatever happens I take with me .. but now she really doesn't want to stay. And I also believe she will do something bad to me to have bad life .. As she always telling that she will destroy me and my family. She always trying to speak bad to me and always angry without matter and she want to give us alsot of problem . You should sit with your wife and talk to whether she wants a divorce if she says yes then both you and your wife should filed a mutual divorce petition u/s 13(B) of hindu marriage act. If she says no their file petition for judicial separation or a divorce petition.
